本人袁静（电话：18728081123），任职于贵公司承建的德阳市旌阳区国防教育训练基地2-20项目资料员。在2022年12月30日上午9点半左右贵方现场项目管理人员肖俊要求上工地协助检测和留取影像资料，在协助现场管理人员、第三方检测单位做完现场检测并留取现场检测影像资料后，在施工现场被贵方正在进行土石方作业的装载机推下的大大小小岩石砸中受伤，先是被一块石头砸中背部后倒下在地，背部朝地，背下均是大小不均的岩石，头上安全帽也被打飞在地，紧接着大大小小岩石滚落下来，几块岩石从身体上滚过，有块大约60cm~70cm长度的岩石压在大腿至膝盖处，导致当时无法动弹、也无法站立行走。后经贵方项目现场管理人员肖俊帮忙搬开砸在身上岩石并送往德阳市旌阳区中医院（黄河院区）救治。经检查，主要伤及左右下肢、背部，其中左腿膝盖、踝关节、大腿较为严重。因当时正处于新冠疫情高发期，医生未安排住院。在治疗期间，医生要求勿走动，需治疗静养。经过5个月的治疗，左腿膝盖目前仍在疼痛且在治疗中，目前还需继续治疗和修养。 在治疗期间，多次要求贵方项目管理人员去医院陪同治疗并去医院了解受伤情况，均以工作忙被拒绝。在我说要“上报”及强烈要求下，仅在2023年1月4日、2023年2月14日陪同看诊治疗。在治疗期间，贵方项目管理人员未曾主动询问病情及伤情恢复情况，也未对针对工伤事件提出处理方案。 于2023年2月14日，在德阳市旌阳区中医院我向贵方项目管理人员周小林提出，双方针对工伤事情商量处理方案，周小林拒绝，口头提出由我本人想好赔偿要求后发给他。由于贵方项目管理人员口头同意承担工伤责任，当时还处于治疗期间，还需继续治疗，于是就等情况好转一点再商量，这期间贵方项目部只支付了医疗费用，未支付工资、护理等其他费用；在伤情好转后，于2023年4月8日将《工伤赔偿协议书》发于贵方项目管理人员，贵方一直到2023年4月27日未曾主动回复，本人电话沟通贵方项目领导层周小林（电话：15883693392）、唐文华（电话：13608109556）、闫志军（电话：19108383388）等人，都以各种理由推托。 在2023年4月27日，告知德阳市旌阳区国防教育训练基地领导后，贵方项目代表肖俊约定于2023年4月28日下午3点与贵方项目代表闫志军、肖俊和土石方分包老板共同协商工伤赔偿问题。贵方项目管理人员与土石方分包老板到场后，不是先询问伤情及恢复情况，而是先指责我为何上工地？为何在施工现场？要划分“责任”问题【施工现场无专职安全员、无安全警示标识标牌、无安全防护网等一系列安全防护措施】。在下午5点左右，未协商出结果，约定于“5.1”节后再次协商，由贵方与土石方分包老板确定时间后，通知我。 在2023年5月6日、5月7日、5月8日联系甲方人员询问协商时间，均未得到回复。在2023年5月9日联系贵方项目管理人员后，给出的回复是“土石方分包老板在5月8日去往贵州，待回德阳后协商”。在2023年5月18日、5月21日、5月22日再次联系贵方项目管理人员后，仍未得到回复，在5月22日下午贵方管理人员提出要给我土石方分包老板联系电话，让我自己联系对方，我不同意。拒绝理由是：1、我是给贵方现场做资料、应贵方要求上工地协助做试验检测及拍照留取影像资料，与贵方存在事实上的劳动关系（虽然无劳动合同）；2、我是在贵方所承建的工地受伤；3、贵方与土石方分包的安全事故的责任关系，他们有义务及责任私下处理，无必要我自己找到土石方分包老板处理。 后经我方多次催促，于5月30日上午10点在贵方工地项目部办公室内与闫志军和分包老板现场协商，仍未有结果，我方于4月8日和5月11日已经将相关资料发给了贵方项目管理人员周小林，闫志军却说未收到相关资料，后经我方说出发送资料时间，又说收到了资料后再次审看，在我治疗期间，我每次强烈要求贵方共同去医生处客观了解伤情及恢复情况，均被各种理由拒绝，现毫无解决问题的诚意可言。 我方从受伤到治疗期间，贵方项目管理人员从未主动询问过伤情，怕贵方不了解伤情引起误会，我方在治疗期间多次要求贵方管理人员到医院陪同治疗和了解伤情，贵方项目管理人员多次推脱，仅在2023年1月4日和2月14日陪同看诊治疗。在我方病情好转稳定后，从4月8日发送《工伤赔偿协议书》至今已接近2个月，贵方一直未有处理意见，前后一直是我方在联系贵方项目管理相关人员，贵方从未主动联系或是回复。我方认为贵方一直在拖延时间，毫无承担责任之意。我方已将相关情况上报业主单位，也已上报市长热线12345，市长热线已委托人社局处理此事，我方已上报相关材料并已受理，如果贵方现场项目部仍不积极处理此事，我方还会继续上报劳动局、安监局以及旌阳区人力资源和社会保障局劳动监察大队等相关管理部门，维护自身合法权益。请贵公司督促项目部相关管理人员早日积极、合理和带着诚意处理此事！
